ACCEPTANCE OF RISK — PLEASE READ BEFORE USE
By using this product—whether for yourself, on behalf of your agency, or for any personnel operating under your authority or direction—you acknowledge and agree that MayDay-IC is NOT a decision-making system and shall NOT be used as the basis for any decision regarding any type of emergency response, tactical operation, medical intervention, resource deployment, or any other action during any incident, for any reason.
Solely relying on this system for accurate, dependable, or actionable decisions can and/or will result in DEATH, DISMEMBERMENT, and/or MENTAL OR PHYSICAL INJURY THAT MAY BE PERMANENT, IRREVERSIBLE, OR OTHERWISE INCURABLE.
By continuing to access and use this system, you expressly agree that you will ALWAYS exercise independent human judgment when deciding upon any response, tactic, strategy, treatment, protocol, or course of action, and when evaluating whether any information presented by this system is true, accurate, complete, current, or applicable to your specific circumstances. No output of this system—including but not limited to AI-generated recommendations, data displays, alerts, triage classifications, maps, protocol guidance, or any other content—shall be treated as a substitute for the professional judgment of trained, qualified, and authorized personnel.
CRITICAL SAFETY WARNING: RISK OF SERIOUS INJURY OR DEATH
MayDay-IC is a supplemental coordination tool. Solely relying on the recommendations, data, outputs, or any information provided by this application may result in serious bodily injury, permanent disability, dismemberment, or death to you, your coworkers, other emergency responders, patients, bystanders, or any other persons involved in or affected by an incident.
This application does not replace professional training, direct patient assessment, established agency protocols, or the professional judgment of qualified personnel. AI-generated recommendations, triage suggestions, protocol guidance, evacuation routes, hazmat data, and all other outputs are advisory only and may be incorrect, incomplete, outdated, or inappropriate for the specific circumstances of your incident.
You assume all risk associated with any actions taken or not taken based on information displayed in, generated by, or entered into this application. Always exercise independent professional judgment, follow your agency's standard operating procedures, and rely on direct observation, communication, and qualified personnel for all life-safety decisions.
1. Not a Replacement for 911 or Dispatch Systems
MayDay-IC is not a replacement for 911, Computer-Aided Dispatch (CAD) systems, or any established emergency dispatch infrastructure. In any emergency situation, always contact 911 or your local emergency number first. MayDay-IC is designed to supplement existing emergency response workflows, not to serve as a primary dispatch or emergency notification system.
Do not rely on MayDay-IC to summon emergency services. The application does not connect to Public Safety Answering Points (PSAPs), dispatch centers, or emergency call systems.
2. Field Data Accuracy
Data entered into MayDay-IC during emergency operations is collected under high-stress, time-critical conditions and may contain inaccuracies, incomplete information, or errors. Field personnel entering data may be operating under duress, in poor visibility, with limited information, or while performing other critical tasks simultaneously.
- Patient information may be based on verbal reports from bystanders or the patient themselves and may not be verified.
- Incident details may change rapidly as the situation evolves, and earlier entries may not reflect current conditions.
- Numerical data (counts, vitals, distances) entered in the field should be treated as approximate unless independently verified.
3. Coordination Tool, Not a Medical Device or CAD System
MayDay-IC is an operational coordination tool. It is not:
- A medical device as defined by the FDA or any equivalent regulatory body
- A certified Computer-Aided Dispatch (CAD) system
- A certified Electronic Health Record (EHR) or Electronic Patient Care Report (ePCR) system
- A certified records management system (RMS)
- A life-safety system or critical infrastructure component
MayDay-IC has not been evaluated, cleared, or approved by the FDA for any medical purpose. It should not be used as the sole basis for any medical diagnosis, treatment decision, or patient care determination.
4. Operational Decisions
All operational decisions—including but not limited to incident command decisions, resource deployment, evacuation orders, triage classifications, treatment protocols, and tactical operations—remain the sole responsibility of qualified, trained, and authorized personnel operating within their scope of practice and in accordance with their agency's policies and procedures.
5. GPS Accuracy Limitations
Location data within MayDay-IC relies on device GPS, cellular triangulation, and Wi-Fi positioning. GPS accuracy varies significantly based on conditions:
- Optimal conditions (open sky): 3–5 meters accuracy
- Urban environments: 10–30 meters accuracy (multipath interference from buildings)
- Indoor/covered areas: 30–100+ meters accuracy or unavailable
- Dense foliage/canyons: Significantly degraded accuracy
Do not rely solely on MayDay-IC location data for navigation, resource positioning, or patient location in critical situations. Always confirm locations through direct communication and visual verification.
6. Network Dependency & Offline Limitations
Many MayDay-IC features require an active network connection (cellular data or Wi-Fi) to function fully. When operating offline:
- Data is cached locally and will synchronize when connectivity is restored
- AI-powered features (Protocol Advisor, AI Translator, PTT Transcription) are unavailable
- Real-time location sharing and map updates may not function
- Push notifications and alerts may be delayed or undelivered
- Locally cached data may become stale and not reflect updates made by other users
7. ICS/NIMS Procedures
MayDay-IC is not a substitute for established Incident Command System (ICS) and National Incident Management System (NIMS) procedures. The application is designed to support ICS workflows but does not replace the need for proper ICS training, qualification, and adherence to NIMS doctrine as established by FEMA and adopted by your agency.
8. Triage Classifications
Triage classifications generated or suggested by MayDay-IC—whether through algorithmic assessment (START, JumpSTART, SALT, ESI) or AI-assisted analysis—are decision-support tools only. They are not definitive medical assessments or diagnoses.
- All triage classifications must be confirmed by qualified medical personnel
- Patient conditions may change rapidly; triage categories should be reassessed regularly
- The algorithms may not account for all clinical factors visible to on-scene personnel
9. Qualifications & Authority
Use of MayDay-IC does not confer any ICS qualifications, certifications, medical credentials, or operational authority upon the user. Users must hold appropriate qualifications, certifications, and authority as required by their agency and applicable regulations before performing any operational functions, regardless of what tools or features MayDay-IC provides.
10. Environmental Conditions
Emergency operations often occur in adverse environmental conditions that may affect device and application performance:
- Extreme temperatures: May cause device battery drain, screen dimming, or device shutdown
- Water/moisture: May damage devices not rated for water resistance in the operating conditions
- Dust/debris: May interfere with touchscreen, camera, or speaker functionality
- Electromagnetic interference: May affect GPS accuracy and network connectivity near heavy equipment or power lines
- Glare/darkness: May affect screen readability and camera functionality
11. Battery & Device Failure
Mobile devices are subject to battery depletion and hardware failure, particularly during extended emergency operations. Contingency planning for device failure is strongly recommended.
- Maintain backup communication methods (radio, satellite phone, landline)
- Carry portable charging solutions for extended operations
- Maintain paper-based backup systems for critical data (ICS forms, triage tags)
- Do not rely solely on any single digital tool for life-safety operations
12. Limitation of Liability
Blue Beard Solutions Inc., its officers, directors, employees, agents, and affiliates shall not be held liable for any injury, death, property damage, or other loss arising from or related to operational decisions, field actions, medical interventions, or any other actions taken or not taken based on information displayed in, generated by, or entered into the MayDay-IC application. MayDay-IC is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or availability.
13. Indemnification
By using MayDay-IC, you agree to indemnify, defend, and hold harmless Blue Beard Solutions Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of MayDay-IC, your violation of these terms, or your violation of any rights of any third party in connection with your use of the application.
